A well-meaning grandparent or relative making a gift or leaving a legacy to a family member with a learning disability, may not appreciate that their generosity could have unintended consequences such as:-

 

• The loss of means tested State benefits for the relative with the disability. 
• A requirement that the appointment of a Controller to manage the gift becomes necessary (both costly and time consuming).
• Making a vulnerable adult more vulnerable to those who could take financial advantage.

 

There are safe and cost effective ways to achieve the same ends by the use of simple Trusts and legal advice should be taken for the greatest protection.  Kind relatives would rather know how to avoid pitfalls, and we can advise them how to maximise such a gift.
